The book “Contracts of enterprise (movable and immovable works: renovation construction), contract for the provision of services (obligations and liability of professionals) and the legal hypothec, 4th edition”, now available at CAIJ!
The fourth edition of Contracts of enterprise (movable and immovable works: renovation construction), contract for services (obligations and liability of professionals) and legal hypothec is now online at CAIJ! It includes significant changes from the third edition in terms of restructuring and the addition of new opinions on new or controversial issues. However, it represents a continuation of the work begun in the three previous editions.
This work is now intended to be a treatise on construction contract law and the liability of professionals, including architects, engineers, lawyers, notaries, pre-purchase inspectors, real estate brokers, accountants, etc. It is also intended to be a guide to the law of construction contracts and the liability of professionals, including architects, engineers, lawyers, notaries, pre-purchase inspectors, real estate brokers, accountants, etc. It now deals in great detail with the rules of law relating to construction and service contracts as well as the legal hypothec to which stakeholders in this industry are entitled. Thus, through its original approach, jurists will find in it a work tool that provides them with the foundations of the rule and the practical aspects of its interpretation and application, as well as a critical but in-depth analysis of the most recent jurisprudence. It brings together in a single chapter various interpretations and applications that each of the relevant provisions may have. In order to meet the needs of practitioners, it attempts to establish a link between substantive and procedural law, as well as rules of evidence.
In reviewing this book, members of the legal community can readily see that the number of judgments rendered in matters of service provider liability is increasing daily, often involving controversial issues. A thorough analysis of the issues raised by the interpretation and application of certain provisions was therefore required. The texts have therefore been revised and restructured to reflect these most recent interpretations and applications of these rules.
